Feeling Safe & Free at work is a right for every employee at all workplace irregardless of your gender, racial, cultural or ethnic background, sexual orientation, and disabilities. A psychologically safe workplace is one where staff feel safe and free to speak up, share ideas, ask questions and make mistakes without any fear of punishment, humiliation or retribution.
Employers now have a positive duty to eliminate workplace sex discrimination and sexual harassment. What it means is that the new positive duty imposes a legal obligation on employers to "take proactive and meaningful action to prevent sexual harassment, sex discrimination, sex-based harassment and conduct that amounts to subjecting a person to a hostile workplace environment on the ground of sex and victimisation from occurring in the workplace or in connection to work" (www.respect@work.org.au).
Since December 2022, the Australian Government introduced the Anti-Discrimination and Human Rights Legislation Amendment (Respect at Work) Bill 2022. This Bill implements seven of the remaining legislative recommendations of the Respect@Work Report, including a positive duty on employers to prevent workplace sexual harassment, sex discrimination and victimisation.
